General Rental Terms

THE FOLLOWING GENERAL RENTAL TERMS APPLY TO THE RENTAL.

1 DEFINITIONS AND GENERAL PRINCIPLES

"You" are the customer (main driver) who signed the rental agreement and who is entitled to drive the vehicle.

"OWVH" is One Way Van Hire SL the rental agreement, hereinafter called OWVH.

"Vehicle" is the car or van that One Way Van Hire SL is renting to you for the agreed duration of the rental agreement and will include all parts and accessories fitted to it at the commencement of the rental.

"Damage" is any damage occurring to the Vehicle (including glass, lights and mirrors) and any damage occurring to third party property where applicable.

2 BASICS: WHAT DO YOU NEED IN ORDER TO RENT A VEHICLE?

You must hold and produce a driving licence valid in the country where the rental takes place. The driving licence must have been issued by authorised authorities at least 12 months before the date of the commencement of the rental. In addition to the normal driving licence, an international driving licence is also mandatory if the driving licence is written in any other language English and/or in characters that can not be read in the renting country. Please note that the international driving licence is valid only if accompanied by the normal driving licence.

When the rental is made outside your country of residence you must also present a valid identity card or a valid passport. In most countries, you must be aged 21 or over to rent a car and have held a driving licence for at least one year. A young driver surcharge may be applicable in some instances.

The above requirements are also applicable to all additional drivers if any.

Credit cards are accepted to the limits authorised by the credit card company.

3 YOUNG DRIVER SURCHARGE

When renting a vehicle, a driver qualified as a "young driver" pays a specific charge -  the "Young Driver Surcharge".

Terms and conditions of the applicable Young Driver Surcharge may vary: it is therefore strongly recommended to consult the OWVHs office at the time of booking

4 THE VEHICLE: CONDITION, USE, BREAKDOWN ASSISTANCE AND MAINTENANCE/MECHANICAL PROBLEMS

4.1 Condition of the Vehicle.
A description of the condition of the Vehicle will be given to you upon collection of the vehicle. Before leaving the rental location, you are required to check the condition of the Vehicle. Where an apparent defect is found which is not already listed in the document, you must immediately inform the OWVH in order to proceed with a joint-examination of the Vehicle. In such a case, amendments must be made to the document and duly countersigned by both parties. If the amended document is not countersigned by both parties, the condition of the Vehicle will be as set out in the document given to you with the rental agreement and it will be considered that you received the Vehicle in proper working condition. You will return the Vehicle in the same condition as it was provided at the start of the rental.  You are responsible for any repair or refurbishment costs and these will be added to the cost of the rental, subject to the conditions of the section as set out below.

4.2 Use of the Vehicle
The Vehicle must not be driven by anyone other than you or any other person who is not named on the rental agreement and then only under the condition that your / their ability to drive is not in any way impaired by mental or physical incapacity or restricted by the Law.

You must take care of the Vehicle, keep it in good repair and condition, pay any fines for which you may be liable, reimburse the OWVH for any damage to the Vehicle, and refund the OWVH for any costs it incurs.

The Vehicle will be provided to you with a empty fuel tank. You must only refuel the Vehicle with the correct type of fuel. Costs of fuel will be at your expense. You are liable for all fees, taxes, fines and penalties incurred in connection with the use of the Vehicle and for which the OWVH is charged, unless they have arisen through the fault of the OWVH. During the rental period you must carry out the usual checks (engine oil level, tyre pressure, etc.) as would any careful user and you must respect the maintenance cycle of the Vehicle as stated in the maintenance guide, if any.

When parking the Vehicle, even for a short period, you undertake to lock it and make use of the Vehicle's alarm and/or immobilisation equipment. You must never leave the Vehicle unoccupied with the keys in the ignition. Non-return of the keys will lead to invalidation of the theft cover.

Non return of the documents for the vehicle will result in a 50€ Charge. In particular, you must not use the Vehicle under any of the following conditions or for any of the following purposes:

- driving the Vehicle under the influence of alcohol, drugs or any other type of narcotic substances,
- transportation of inflammable or dangerous goods, as well as toxic, corrosive, radioactive or other harmful substances,
- carrying anything which, because of its smell or condition, harms the Vehicle or causes the OWVH  to lose time or money before it can rent the Vehicle again,
- transportation of live animals (with the exception of domestic pets, subject to prior authorisation by the OWVH),
- with a roof rack, luggage carrier or similar, unless supplied by the OWVH,
- re-rental to or use by other persons,
- carrying passengers for hire or reward,
- participating in rallies, competitions or trials, wherever they may take place,
- giving driving lessons,
- pushing or towing another vehicle (except those vehicles equipped by the OWVH  with a towing-hook; maximum load 1,000 kg), or exceeding the authorised load weight.
- travelling on non-paved roads or on roads, the surface or state of repair of which could put the vehicle's wheels, tyres or its under body mechanics at risk,
- intentionally committing any offence.
- none of the goods and baggage carried in the Vehicle, including their packing and stowage equipment, will be permitted to damage the Vehicle, nor put the occupants abnormally at risk,
- in any way which breaks the highway Code, road traffic laws or any other laws in the county of travel.

You will be liable for any offence committed during the rental period which relates in any way to your use of the Vehicle, as if you were the owner of the Vehicle. Upon the request of the Police or any official body the OWVH may have to transfer your personal data. Such transfer will be done in accordance with the data protection.

4.3 Maintenance / Mechanical Problems
The Vehicle has been provided to you with a full set of tyres in good condition. In the event that any of them is damaged for any reason other than normal wear and tear, you undertake to replace it immediately at your own expense with a tyre of the same dimensions, type and wear characteristics. You must stop the Vehicle if any of the instrument panel warning lights, which are intended to indicate the existence of a mechanical problem, light up, or if you become aware of anything else which may indicate the presence of a mechanical problem with the Vehicle.

When the rental starts, the Vehicle will be roadworthy and fit for normal use. If it is not, or if it becomes un-roadworthy or unfit for normal use during the rental because of mechanical breakdown or accident, you must inform the OWVH immediately. The OWVH will have the choice between replacing the Vehicle or accepting repairs to be done to the Vehicle. In the latter case, repairs can only be made after written or oral confirmation from and instructions given by the OWVH as well as prior acceptation by the OWVH of the estimation of costs. You must be able to provide the name of the OWVH representative accepting the repairs. Without prejudice to any question of liability, the expenses for the repairs may be charged directly to the OWVH. If not, the OWVH reserves the right to request from you the remittance of the defective pieces and the paid invoice. The fees and expenses of any repair undertaken without the order of OWVH will not be reimbursed to you. You must inform OWVH, or one of its representatives, of all accidents, damage to or breakdowns of the vehicle, even those which may already have been repaired, when you return the Vehicle. You will remain liable for any damages to OWVH. In any case, neither OWVH nor its directors, officers or employees will be liable to you for any loss or damage (including but not limited to loss of profit or earnings...) nor, to the extent permitted by the Law, for indirect consequential damages whether your action is based on contract or in tort.

4.4 Breakdown Assistance
For the length of the rental, as agreed with OWVH, you have the benefit, at no extra cost, of a Breakdown and Assistance Service. In order to benefit from this cover, you must make contact with the Breakdown and Assistance Service immediately after the occurrence of the incident. If you do not contact the Breakdown and Assistance Service and if you initiate steps or make any disbursements without the prior consent of OWVH, you will not be able to claim for reimbursement of the expenses.

5 RENTAL PERIOD

5.1  Principle and Calculation
You undertake to return the Vehicle to OWVH at the agreed place, on the date and at the time agreed The maximum duration of a rental agreement may vary. The rental duration is calculated on the basis of indivisible periods of 24 hours, starting from the time the Vehicle is made available. However, a 30 minute grace period is applied at the end of the rental before the start of a new 24-Hour period. If you return the Vehicle to any other OWVH rental location than the agreed location, repatriation costs will be charged to you.
5.2  Extension of the Original Duration of the Rental
Should you wish to keep the Vehicle for a period longer than that originally set out in the rental agreement, you are must first contact by phone OWVH Head Office in order to extend the duration of the rental agreement The Vehicle is insured for the period mentioned on the rental agreement. Unless otherwise agreed in writing by OWVH, once this period is passed, the contracting party remains liable for any damages to OWVH.

5.3 Delivery and Collection Terms
Where you ask OWVH and OWVH agrees in writing to deliver the Vehicle or to collect the Vehicle, you may have to pay additional charges and follow additional instructions. You must check at the time of reservation. When you return the Vehicle, or if OWVH has agreed you will do so, when you leave the Vehicle for collection by OWVH, you must complete the details of the date and time of return, the mileage and fuel gauge reading and other information shown on the rental document wallet. You must also do anything else, which OWVH requests as a condition of agreeing to collect the Vehicle.  You must return the Vehicle immediately if OWVH asks you to do so. In the event that the Vehicle is not delivered to OWVH upon request you hereby authorise OWVH to enter your premises and to do any and all other things necessary to repossess the Vehicle. You will be liable for any costs associated with such repossession. OWVH may repossess any vehicle without notice or liability where OWVH deems that such repossession is necessary for its own protection.

5.4 End of Rental
The end of the rental is defined by the return of the Vehicle and of its keys to the agreed location. This must be done to a OWVH representative and under no circumstances should you give the keys to any person present at the OWVH location and who you assume or who purports to be a OWVH representative. If explicitly mentioned in writing in the rental agreement the keys may be returned to the reception desk of a hotel. If the Vehicle is returned without its keys, you will be invoiced for the cost of the replacement keys. Under no circumstances will OWVH accept any liability for articles that may have been left in the Vehicle at the end of the rental. IMPORTANT NOTE: Outside the normal opening hours, depositing the keys and documents in a letter box does not constitute the end of the rental. You remain liable for any damages until a OWVH employee takes possession of the Vehicle, documents and keys.

5.4.1  In the event of confiscation, theft or accident
In the event of measures by third parties, including attachment, confiscation or impounding of the Vehicle, you must immediately inform OWVH by telephone and then in writing. OWVH will then be entitled to take all measures which it deems necessary to protect its rights. You will be liable for all damage, cost and/or expenses associated with the above measures and for any direct, indirect, consequential damages (such as loss...) to the Vehicle unless it is demonstrated that OWVH is directly responsible for such confiscation or impounding of the Vehicle. Furthermore, the rental agreement may be automatically terminated as soon as OWVH is informed of such action by the legal authorities or by you. In the event of theft of the Vehicle, the rental agreement will be terminated as soon as OWVH has received a copy of the theft declaration made by you to the police authorities. In the event of an accident, the rental agreement will be terminated as soon as OWVH has received a copy of the accident report completed by you and, where applicable, the third party. If OWVH provides a new vehicle, the rental agreement will be amended accordingly.

Furthermore OWVH will have no responsibility for loss, theft, robbery or damage of whatever nature relating to objects and/or utensils transported

6 RATES / TERMS OF PAYMENT

Payment of security deposit is made by means of a credit / debit card, The minimum amount of the security deposit is 350€, this may vary at the discretion of OWVH

7 INSURANCE

IMPORTANT NOTE: Damage to the under body-work and/or roof due to collision with bridges, tunnels, overhanging structures etc., is excluded from the damage cover, unless force majeure can be proved.

7.1 You will be liable for any damages to OWVH when renting a Vehicle that has been entrusted to you.
Therefore, in the event of theft of the Vehicle or damages caused to it, you must fully indemnify OWVH (the indemnification will include the amounts corresponding to the repair costs, resale value of the Vehicle, loss of use, administration charges...).  The amount will not exceed the market value of the rented vehicle at the time of the event. Therefore, at the end of the Rental, IN THE EVENT OF DAMAGE OR THEFT, YOU WILL BE DEBITED - IN THE EVENT OF LIGHT DAMAGE, YOU WILL BE DEBITED you will not be exempt from liability towards OWVH in the case of breach of contract. Therefore, you will be responsible for any financial loss OWVH suffers as a result of such breach and for any relevant claims made by other people. You agree to pay any amounts OWVH spends in enforcing these terms.  THEREFORE IN ANY CASE, NEITHER OWVH NOR ITS OFFICERS, DIRECTORS, EMPLOYEES WILL NOT BE LIABLE TO THE CONTRACTING PARTY FOR ANY AMOUNTS NOR FOR ANY ACTIONS, LAW SUITS OR CLAIMS RELATED TO ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE DAMAGES (SUCH AS LOSS OF BUSINESS, LOSS OF PROFIT) ARISING OUT OF OR IN CONNECTION WITH THE RENTAL OR THE USE OF ANY VEHICLE WHEHER THE ACTION IS BASED ON CONTRACT OR IN TORT. YOU WILL INDEMNIFY AND HOLD OWVH HARMLESS FROM ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES OR EXPENSES ARISING OUT OF THE RENTAL AND/OR THE USE OF THE VEHICLE.

7.2 Light damage (valid only if applicable)

Both at check-out and check-in OWVH will, together with you, record in the rental agreement all visible light damage to a vehicle in compliance with the detailed list of light damages and repair costs which you hereby acknowledge. At check-out unrepaired damage must appear on the rental agreement with the appropriate signatures by you and OWVH. At the end of the rental i.e., at check-in, the identification of any new light damage must be added to the rental agreement. Any new light damage will be immediately pointed out to OWVH, mentioned in the rental agreement, and signed by you and OWVH. This damage will be charged to you. These repair costs will be directly billed to you by OWVH and will include the cost of the damage repair as well as administration charges, immobilisation costs, spare parts and labour costs. The above-mentioned invoiced repair costs are payable under the same conditions as for the payment of the rental agreement.

8 DATA PROTECTION LAW

Please note that in the course of the performance of the booking as well as the rental process, OWVH collects some personal data. It is mandatory to provide all the information requested; in the absence of such information, OWVH will not be able to correctly ensure the booking and/or the rental.

Payment Terms and Conditions

This OWVH payment Confirmation is subject to the following terms and conditions (the "Terms"). If the customer does not agree to these Terms, the customer may cancel this reservation as provided in Section 5 below. Otherwise, the customer acknowledges having read and understood these Terms and agrees to be bound by them.

1 - Rates exclude all applicable charges which are not expressly mentioned on the OWVH Payment Confirmation as included, and any optional additional services for which the customer may be liable. A valid passport or identity card along with a credit / debit card must be presented to the OWVH representative at time of pick-up to cover any additional anticipated charges not covered by the prepaid amount

2 - Amendment to the reservation may affect the rental rates and may require a new OWVH Payment Confirmation to be issued. Changes requiring a OWVH Payment Confirmation to be reissued must be made at least 14 days prior to rental start date, unless the new OWVH Payment Confirmation can be sent to an E-mail address, in which case changes may be made up to 72 hours prior to rental start date.

3 - All cancellations must be received in writing by any means by OWVH with the OWVH Payment Confirmation attached and will take effect on the date and time received by OWVH. A cancellation confirmation shall be sent to the customer.

The customer may cancel the reservation provided it is done within 5 working days after reservation (reservation day included), After this period has elapsed, the prepaid rental amount shall be not refunded.

No refunds shall be given if the customer fails to collect the vehicle on the rental start date and has failed to notify OWVH in writing in advance of this date.

4 - If the amendments to the reservation are not done according to Article 4, no refunds shall be given for rentals ended early or late collections, if the customer fails to collect the vehicle on the rental start date or cancellations made after the due rental start date.

5 - All rentals are subject to standard terms and conditions of the OWVH Rental Agreement in effect at the time and place of rental. Minimum rental age and pre-requisites to drive a OWVH vehicle may vary by vehicle category.

6 - All drivers must have a valid driver licence in effect at least one year (or more according to the renting country and the vehicle category) prior to the rental start date and present it to the OWVH at the commencement of the rental.

7 - Rental days are based on 24-hour periods commencing at the time of pick up. Additional day charges will apply if the OWVH vehicle is kept longer than specified (additional days begin after a 30-minute grace period and will be billed at the public rate).

8 - All drivers are informed that any information is supplied voluntarily in order to provide the vehicle rental service and will be stored on a computerised database.

9 - You expressly acknowledge and agree that OWVH, its officers, directors, employees shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if OWVH has been advised of the possibility of such damages), resulting from the booking and prepayment.

Satellite Navigation Hire Terms & Conditions

1a. We aim to provide you with a good service at all times, however, due to the nature of satellite navigation, it is impossible to provide a fault free service. The quality and coverage of the service is dependant upon various factors and may also be impaired by geographic, atmospheric and other conditions or circumstances beyond our control. No responsibility will be accepted, or credit given by Us for network transmissions or reception conditions experienced during the rental period.

1b. We will not accept responsibility if the equipment does not use the best route or is not accurate with arrival times or does not get You to Your required destination.

Returning the Equipment

All equipment must be returned to a OWVH representative only.

2a. If The equipment remains in your responsibility until it is received by the terminating rental station.

2b. A valid Return Receipt is required as proof of return. Inability to provide this documentation will result in the full replacement cost (250€) of the equipment being charged to your credit / debit card.

Lost/Stolen/Damaged Equipment

You must take reasonable care to ensure that the unit is not lost, stolen or damaged. In the event Your equipment is lost or stolen, You will be charged 250€.

3a. In the event of accidental damage, the equipment must be returned to Us and You will be charged up to 250€.

3b. You are responsible for the replacement of all accessories should any of them be lost, stolen or damaged. The charges are as follows and are all inclusive of IVA (18% Spanish Tax): Windscreen Mounting Bracket 25€, Vehicle Power Adapter 35€, Carry Case €25.

3c. No waiver purchased from OWVH removes your liability for lost, stolen or damaged units.

General

For security purposes, all equipment (including accessories) must be locked out of sight from unattended vehicles. In the event of experiencing problems during your rental period, contact with a OWVH Representative must be made immediately upon detecting the problem. No credit will be given if a call is not made to us or is not made until after the equipment has been returned. We reserve the right to revise these Terms and Conditions and any rates at any time. Any changes will be communicated to you. By continuing to use the Service, You will be deemed to have accepted the changes. If the revised terms and conditions are not acceptable, you may terminate the Agreement without penalty. To terminate the Agreement, the unit must be returned to a OWVH representative and a Return Receipt obtained.

Age : Minimum driver age is 21, 25, 28 or 30 years, according to the vehicle group.  When renting a vehicle, a driver qualified as a "young driver" (from 21 to 25 years old) pays a specific charge (from 30€ per day) (the "Young Driver Surcharge").

Additional Driver : With the consent of the renter, the vehicle may be driven by other persons only with written consent from OWVH

Driving licence: A full and valid driving licence must have been held for a minimum of 12 months. The new style UK driving licence must be accompanied by its counterpart. The paper counterpart is never acceptable on its own, both parts need to be presented at when collecting the car or van along with a copy held with OWVH Head Office

Cancellation and No Show Policy:

If you have chosen to pay for the car or van upon collection of your car or van and your travel plans change, you may cancel your booking free of charge anytime up until two hours before your rental is due to start. However you will forfeit your security deposit .We will guarantee your car or van until close of business on the day your rental is due to start.  Should you fail to pick up your car or van on the day your rental is due to start, or do not cancel with more than two hours notice prior to the time it is due to start, you will be required to pay 100€ which will be charged to your credit/debit card to compensate us for having held the car or van for you without any rental transaction taking place.

Standard Deposits:

All rentals are subject to a standard 350€ deposit at the time of rental in addition to the appropriate rental charges.

Refunds:

Refunds are given 4 weeks after the return date of the vehicle Note: Refunds may take up to 10 working days to credit in to your bank account/ credit card account.

Lost Property:

Any property placed in the car or van is at your own risk and OWVH takes no responsibility for it. You must check you have not left any personal property in the car or van before you return it back to OWVH Any unclaimed property will be disposed of 1 week after the end of the rental period.

Congestion Charges

There are some cities in the UK, for example London and Durham that charge congestion fees for driving in and through them. You are liable for the payment of such fees.

 

I agree to be bound by the terms and conditions and the exception of the policy which I have had the opportunity to see and read.
